Wage and Overtime Claims

Under the Fair Labor and Standards Act, if employers meet certain criteria, they shall pay their employees overtime.  Many employers either don’t know or ignore their obligations to pay their employees overtime.  The overtime rate is the employees hourly rate plus half of the hour rate.

In overtime cases, the employee does not pay their attorney an hourly fee.  Instead, the employee’s attorney takes a portion of the settlement amount, depending on how much time he dedicated to the file.  The law provides for the employer to pay an attorneys’ fee if the employee’s attorney is successful and obtaining ANY overtime.

Overtime cases are routinely brought in Federal Court and experienced trial lawyers are required in order to maneuver through all legal hurdles.
